I think I see Todd's point. The liability scales with the intentional
malice. With increased liability comes increased responsibility (
to paraphrase Spiderman).
However, I don't see how you could license the protocol and it is
from incorrect implementations that we need protection, so anything that
decreases the likelihood of using the reference implementation is a
net loss in my opinion.
